When filling out the order, the client will be asked to give the following information on the Arctic Explorer website: first name, last name, email address, phone number, and delivery address. The seller (Arctic Explorer) will use this information to provide the best and quickest possible service to the customer.
Arctic Explorer will not disclose any client information. This does not include information that the seller has to make public to a third party (i.e. delivery services) in order to provide the best possible service to the customer and to fulfil the seller’s obligations in full.
Disclosure of information by request of law services is not considered a breach of security or privacy form the seller toward the client. The seller is not responsible for the information provided by the client on the website in a public form.
BASIC CONCEPTS
Website visitor – a person who visited myarcticexplorer.com without the intent of placing an order.
User – a website visitor who agrees to the seller’s terms and conditions and wishes to place an order on the online-shop of myarcticexplorer.com
Buyer – a user who places an order off of the internet-shop myarcticexplorer.com
Seller – LLC «ARCTICEXPLORER» Legal address: 127473, Moscow, Seleznevskaya Street 11, p. 3, apt. 7, Registration number 1137746607899.
Internet-shop – a website owned by the seller, located at the internet address myarcticexplorer.com, where the seller offers items for sale, has established terms for payment, a process for payment, and a delivery service of the desired items to the buyer.

Items — clothes, accessories, and other goods offered for sale on the seller’s website.
Order – a buyer places a request for the purchase and delivery of an item or several from the seller’s online-shop, to an address specified by the buyer, or for a self-pick-up agreement.
1. GENERAL CONDITIONS
1.1. The seller offers items for purchase through an online-shop located at the website myarcticexplorer.com.
1.2. When ordering items off of the online-shop, the buyer agrees to the terms and conditions of sale and payment from the seller, further explained below (Conditions for the Sale of Goods). In the event of a disagreement between the user to the seller’s conditions (later elaborated in Agreement/Public Offer), the website visitor is obliged to stop using the service and leave the website http://www.arcticexplorer.com.
1.3. The Conditions for the Sale of Goods, and the information presented about said Goods offered for sale – together are defined as a Public Offer as classified by Article 435 and Clause 2 of Article 437 of the Civil Code of the Russian Federation.
1.4. The Conditions for the Sale of Goods may be changed unilaterally by the seller without conferring with the clients. The new Conditions must be published on the seller’s public website and will only enter into effect 10 days after their publication on the website, unless otherwise stated by the newly established Conditions.
1.5. A public offer is recognised as accepted when the website visitor/buyer places registers onto the website and provides the necessary information to initiate the purchase and confirm the order. The buyer can do this without authorisation from the website, likewise the buyer can make an order or accept a public offer over the telephone +7(495) 268 05 27.
The sale is considered final and contract-bound when the seller issues a receipt or other documentation to the buyer confirming their payment for the goods offered for sale.
By providing their email and telephone number, the website visitor/user/buyer gives their agreement to the specified means of communication, sale, and delivery by the seller – including working via third parties to best fulfil the seller’s obligations to the website visitor/user/buyer, in the scopes of advertising, marketing communication, offer presentation, promotional offers, and other events of the seller. This also extends to payment and delivery services, item transfer, and extends to other information that may be needed to gather to best fulfil the seller’s obligations to the website visitor, user, or buyer responding to their public offer.
2. SUBJECT OF AGREEMENT
2.1. The subject of agreement to the Conditions for the Sale of Goods is for the seller to provide the website visitor, user, or buyer the opportunity to purchase the seller’s items for personal, family, home, office, or other needs not related to entrepreneurial activities. The goods and items in question can be found in the catalogue of the online-shop at website myarcticexplorer.com.
2.2. This agreement extends to all items found on the website, all offerings outlined in the catalogue of the online-shop, and all conditions outlined on the website.
3. REGISTRATION ON THE WEBSITE
3.1. Registration on the website is initiated through the «Registration» portal.
3.2. Registration on the website is not required to place an item order.
3.3. The seller is not responsible for the accuracy and legitimacy of the presented information by the website visitor, user, or buyer in their registration.
3.4. The website visitor, user, or buyer must not disclose their information (log-in and password) used in registration to third parties. In the event that the user is unsure about the security of their information or the possible of it being used by third-parties without the user’s sanctioning, the user must immediately contact the seller outlining their worries in an online letter sent to: info@arcticexplorer.ru
3.5. Communication between the user/buyer and operators at the call-centre, managers, or other representatives of the seller should flow in accordance with general principles of communication morality and etiquette. It is forbidden to use vulgar language, offensive expressions, threats, blackmail, no matter in what form or to whom it is addressed.
4. OFFERED GOODS AND THE PURCHASING PROCESS
4.1. The seller must ensure that the items and goods offered on sale are in-stock at their respective storage facilities and ready for distribution. The photographs used to display the item are general photographs and the item itself may slightly differ from the images. The written-out descriptions and details of the items are not claimed to be exact or perfectly meticulous and may contain typos. If the user/buyer wishes to receive the meticulous description of an offered good, the user/buyer can contact the seller’s Customer Support at: info@arcticexplorer.ru. The information on the website is updated every 30 minutes.
4.2. In the event of a buyer’s ordered item being unavailable or not-in-stock, the seller must immediately contact the buyer – however, the seller reserves the right to omit the case-specific item from the overall order or to annul the buyer’s order. The buyer will be notified by an appropriate email or telephone call. Likewise, the buyer can contact the seller over the same subject either through email or by calling the seller’s Customer Support centre.
4.3. In the event of a cancellation of a fully paid, or partially paid, order, the seller must return the money equal to the cost of the cancelled good to the buyer, by the same means that the buyer used to originally pay for the order.
4.4. The buyer’s ordered is carried out by in accordance with the procedures outlined on the website in the «Order Registration» section.
4.5. The buyer is fully responsible for presenting false or inaccurate information to the seller, with results in the seller’s inability to correctly carry out their obligations to the buyer.
4.6. After placing an order on the website, the buyer is provided with delivery information and an estimated delivery date for the purchased goods – via an email to the buyer’s specified online address, or by telephone. The manager overseeing the buyer’s order must confirm the details of the order and the buyer’s details, the availability of the desired items for purchase, and the estimated delivery date – which depends on time required to process the buyer’s order for delivery, the item availability in the warehouse, and the distance of delivery travel.
4.7. The expected date of transferring the ordered goods to delivery service is notified to the buyer by the manager overseeing their order – via email or telephone. The date of item transfer can be changed by the seller if there are objective and sufficient enough reasons.
5. ORDER DELIVERY
5.1. Specified delivery dates can be agreed upon by the buyer and seller via the seller’s call-centre before processing the order, +7(495) 268 05 27. Information about time of delivery can also be found http://www.myarcticexplorer.com/page/delivery.
5.2. The territory for delivery of items and goods offered on the website is limited to the Russian Federation.
5.3. Delays in delivery can occur due to unexpected, unforeseen circumstances that did not occur by the fault of the seller.
5.4. Upon delivery, the order is handed over to the buyer or to a third party specified in the order as the recipient (from here on, the buyer and the third party will be referred to as the "recipient"). If it the order is specified to be paid in cash upon delivery, and the recipient cannot carry out the transaction, the order will be handed over to a person who can provide the information about the order (shipment number, and/or recipient name), as well as pay the entire sum of the order.
5.5. In order to avoid fraud, and to best fulfil the obligations specified in clause 5. of this Agreement, when delivering the order, the person carrying out the delivery can request the recipient to present an identity document as well as a reciept or some form of documentation confirming their order form the seller. The seller guarantees the privacy and protection of the recipient's personal data (clause 9.3).
5.6. The risk of damaging or losing the ordered goods is passed on to the buyer from the moment of delivery. The buyer will additionally be asked to sign off on a document confirming that the delivery has arrived. Thereafter, the risks and damages incurred fall onto the buyer. In case the order is never delivered, the seller shall reimburse the buyer for the cost of the order (if it has been prepaid) and delivery paid by the buyer, in full, after confirming that the order was indeed lost during delivery.
5.7. The cost of each delivery is calculated individually by factor of weight of the purchased goods, the destination of the delivery, the delivery method, and (if necessary) the form of payment, as is indicated on the website at the last stage of placing an order.
5.8. The seller’s obligation to deliver the item to the buyer is considered fulfilled in the moment the courier delivers the goods to the recipient, or the recipient receives the delivery from a postal service.
If the recipient is collecting their order at the post office, the recipient, having already paid for the goods, must inspect the delivery and open it in the presence of a Russian Post worker to check if the items and goods delivered are in good quality, in the necessary assortment, quantity, and completeness. The recipient can check the integrity of the item's packaging. If there are claims of inadequacy (item defects, shortages, missing items - unless the seller previously informed the buyer of shortages), the Russian Post employees will present the Report on Discrepancies document to the recipient. If the recipient does not file their claim in the above document, the seller can consider the ordered goods were in good quality and the obligations to the buyer have been fulfilled.
In the event the recipient wishes to return the delivered goods via the Russian Post, the recipient must present claims against the goods as well as the following documents:
- Application for a Refund
- A copy of the Report on Discrepancies
- A copy of the receipt of payment
- A copy of the order number
- A return form.
5.9. When accepting the delivery from a courier, the recipient must inspect the package for any damages, for its completeness, quantity of items, and assortment of items, and for the integrity of the packaging. If there are no claims, the recipient signs the "Order Delivery Form" and pays for the order (if it has not been prepaid in full). The recipient's signature on the delivery documents indicates that the goods were in acceptable quality and the seller has fully fulfilled their obligations to the buyer.
5.10. The time spent by the courier at the recipient’s address is limited to 15 minutes.

5.12. The recipient can clarify or choose a date, time, and, if necessary, the delivery route of the order with the manager overseeing the order from the seller’s side.
5.13. The website visitor/user/buyer and/or recipient understands and agrees that: the order delivery is a separate service to the online-shop and the purchase of goods thereof. The delivery si fully executed when the recipient receives the goods and confirms so with a signature on official documentation confirming the order's delivery. If the order was not prepaid in full, the recipient is also responsible for paying for the goods upon delivery. Dissatisfactory claims against the quality of the purchased goods, arising after the payment and acceptance of the delivered goods, are considered in accordance to the Russian Federation's Law "On Protection of Consumer Rights" and the warranty obligations of the seller. In this case, the purchase of goods with delivery does not give the buyer the right to demand the delivery of replacement items or warranty services, does not grant the opportunity of warranty services or replacements being delivered to the buyer, and does not imply the return of the costs of the delivery to the buyer in cases where the buyer and the right to a refund for the goods, in accordance to the Russian Federation Law "On Protection of Consumer Rights."
6. PAYMENT FOR THE GOODS
6.1. The price of goods is displayed in Russian Federation Rubbles and includes Value Added Tax.
6.2. The price of goods is displayed on the website. In case of incorrect price listings on goods ordered by the buyer, the seller must inform the buyer of the correct price to either confirm the order or to cancel it. If the buyer cannot be contacted, the order is considered to be cancelled. If the order was already paid for, the seller will return the money via the same channels that the transactions took place through.
6.3. The price of goods on the website can be changed by the seller unilaterally. On the other hand, the price of goods paid by the buyer cannot change. The price of goods offered may change depending on the buyer’s region.
6.4. Conditions of payment for a good using bank cards:
6.4.1 In accordance with the Central Bank of the Russian Federation regulations, "On the issue of bank cards and on transactions performed by using payment cards" dated December 24, 2006, № 266-P, bank card transactions are initiated by the card holder or an authorized party.
6.4.2 Bank card transactions are authorised by the card holder's bank. If the bank has reason to believe the transaction is fraudulent, it can refuse to initiate the payment. Bank card fraudulent transactions fall under Article 159 of the Russian Federation's Criminal Code.
6.4.3 In order to avoid cases of fraud or unauthorised payment, all orders placed on the website and that are prepaid, all orders and card information is checked by teh seller. To verify the identity of that card holder and the elgibility of the card, the seller has the right to demand an identity document from the buyer.
6.5. The seller can provide discounts on goods and establish a programme of bonuses. The types of discounts, bonuses, promotional offers used - their procedures and conditions are indicated on the website and can be changed by the seller unilaterally.
If/when applying the discount or bonus onto an order, the recalculated cost of the goods goes to a fraction of a Rubble (or any other such currency), the sum will be rounded down to the nearest Rubble (or any other currency).
6.6. When carrying our marketing activities involving added investment or items into the buyer's order, the cost of delivery of said promotional items is incurred by the buyer. In order to refuse the additional goods and costs thereof, the buyer needs to contact the seller's customer service hub.
6.7. Upon delivery of the ordered good through the Russian Post, the total sum of the goods may rise depending on the size and distance of delivery. For further elaboration, the buyer can call at the following telephone number: +7(495) 268 05 27.
6.8. The seller keeps statistics and documentation of orders purchased by buyers. The order is considered incomplete if the buyer notifies of a change in the order before the order's assembly at the warehouse. If the buyer contacts the seller after the order is assembled at the warehouse, then the order is considered rejected. The seller maintainss the right to refuse the buyer's conditions upon two cases: Firstly, if over teh buyer's last 4 orders, the volume of items rejeced totals exceeds 80% of the total volume of goods and items delivered to the buyer. Secondly, if the buyer's incomplete and cancelled orders surpass 60% of the total volume of goods ordered and the number of incomplete orders is at least 5. The buyer will be able to redeem themselves after placing one-to-three orders totalling at 7,000+ Rubbles per three months.
6.9. The seller can limit the payment methods available to the buyer depending on the size of the order. The "Upon Receipt" payment method is not availabe for orders taht contain more than 40 items, or the total sum of payment exceed 350,000 Rubbles.
7. RETURN OF ITEMS AND MONETARY REFUNDS
7.1. The return of goods is carried out in accordance to the procedure outlined in the "Terms and Conditions for Return" which can be foudn on the website http://www.myarcticexplorer.com/page/return.
7.2. Return of Goods of Good Quality:
7.2.1. The buyer retains the rights to refuse the ordered goods at any time before receiving the order - and after recieving the order within a period of 365 days, excluding the day of purchase (with the exception of goods and items specified in clause 7.2.4. of the present Agreement). Return of good quality items is possible in the events that the items retain their presentaiton, consumer properties, features, as well as if the buyer can present documentation confirming prior purchase.
7.2.2. If the buyer refuses the goods, in accordance to clause 7.2.1., the seller refunds the buyer the cost of the goods, but seller can deduct delivery and transport expenses associated to the buyer's address and delivery costs. The money will be returned within 10 days form the date of arrival of the returned goods and items to the seller's warehouse, together with a Return Application fileld out by the buyer.
7.2.3. If, at the time of the buyer's appeal on the delivered good and process of return, a similar product is not available for sale from the seller, the buyer can refuse to execute this Agreement and demand a refund of the monetary sum spent on the previously-purchased and now returned goods. The seller must return the money paid by the buyer for the good within 10 day sof the date of return of the goods.
7.2.4. Not included in the refund policy are perfume and cosmetic products, textile products (linen, silk, cotton, woolen and synthetic fabrics, goods made of non-woven materials such as fabrics - ribbons, braid, lace, and others), sewing knitwear, and clothes that come into direct contact with the wearer's body like swimwear, underwear, hosiery, etc. (in accordance with the List of Non-Food Goods of Good Quality, Not Subject to Return of Exchange for Similar Goods of Other Sized, Shapes, Dimensions, Styles, Colors, or Packaging approved by the Decree of the Government of the Russian Federation on January 19, 1998, N. 55).
7.3. Return of Goods of Inadequate Quality:
7.3.1. Goods of inadequalty quality include goods that are defective, that cannot ensure their marketed performance, that cannot deliver their functional properties. Any goods for sale must comply with their specifications and descriptions as told on the website. Difference in design or decoration do not factor into this sector, this deals exclusively with the adequacy of the good and whether it can carry out the properties and functions it is told to have.
7.3.2. The appearance, adequacy, and completeness of the order must be checked by the recipient upon receiving the delivery of the goods – either form a postal office or from a courier.
7.3.3. Upon delivery of the goods, if the recipient signs their signature on the delivery reciept document in the column: "The order has been accepted, I have no complaints about the adequacy or quality or completeness of the delivered goods." After recieving the order and goods, claims as to their external defects, quantity, quality, completeness, presentation, or adequacy are not accepted.
7.3.4. If the recipient was delivered goods of inadequate quality, and this was not agreed upon between the seller and the buyer, the buyer has the right to use provisions found in Article 18 of "Consumer Rights in the Event of Defects in a Product" of the Consumer Rights Protection Act.
7.3.5. Claims of a refund for the sum of money paid for a defected good must be satisfied within 10 days of the presentation of this claim, if accepted (Article 22 of the Law of the Russian Federation "On Protection of Consumer Rights").
7.4. Refunds are made by returning the cost of paid goods to a bank card or by postal order. The method desired should be indicated in the appropriate field when filing out the application for returning the goods, which can be found at http://www.myarcticexplorer.com/page/return.
8. RESPONSBILITY
8.1. The seller is not liable for any damages caused to the buyer due to improper use of the purchased goods at the online store.
8.2. The seller is not responsible for the content, operation, and functionality of external websites.
9. CONFIDENTIALITY AND PRIVACY PROTECTION
9.1. The user/buyer personal data is processed in accordance to the Russian Federation Federal Law "On Personal Data" № 152-ФЗ.
9.2. When registering on the website, the user provides the following information: name, last name, patronymic, contact phone number, email address, date of birth, and delivery address of the goods.
9.3. By submitting personal data to the seller, the website visitor/user/buyer agrees to be processed into the seller's database, for the purposes of the seller being able to fulfil obligations to the website visitor/user/buyer at maximum, but this extends to the framework of a public offer and includes the seller being able to promote goods and service, conducting electronic and email surveys, monitoring results and statistics of a marketing campaign, general customer support, organizing delivery of goods to the buyers, holding giveaways or prize raffles among website visitors/users/buyers, monitoring the satisfaction and activity of the website visitor/user/buyer as well as the quality of the service offered by the seller.
9.4. The processing of personal data is understood to mean any action (operation) or a set of actions (operations) performed using automation tools or without using such tools with personal data, including collection, recording, categorizing, systemization, accumulation, storage, clarification (updating, modification), extraction, use, data transfer (to third parties that help fulfil the seller's obligations to the buyer, including cross-border transfer), depersonalization, blocking, deletion, destruction of personal data. 9.4.1. The seller has the right to send informational and promotional offers, including advertising messages, to the user's/buyer's email and mobile phone with previously granted consent, expressed by means of prior registration by the user/buyer. The user/buyer likewise reserves the right to refuse to receive informational or promotional offers from the seller, but needs to inform the seller of his refusal at + 7 (495) 268 05 27 or by sending an email to the seller's email address: info@arcticexplorer.ru. Service messages informing the user/buyer about their order, its processing and its stages of movement are sent automatically and cannot be rejected by the user/buyer.
9.4.2 Revocation of consent to the seller processing the website visitor's/user's/buyer's personal data is carried out by revoking the acceptance of the seller's public offer.
9.5. The seller has the rights to use the "Cookies" technology. Cookies do not contain confidential information. The website visitor/user/buyer hereby agrees to the collection, analysis, and use of cookies including cookies of third parties for the purpose of the seller generating statistics, analysis, and optimizing advertising messages.
9.6. The seller receives information about the IP address of the website visitor/user/buyer when accessing the website www.myarcticexplorer.com. This information is not used to identify the visitor.
9.7. The seller is not responsible for the information provided by the website visitor/user/buyer in a public form.
9.8. The seller has the right to record telephone conversations with the user/buyer. In this case, the seller must: prevent attemps of unauthorized access to information obtained during telephone conversations, and/or its transfer to third parties not directly related to the execution of delivery of ordered goods, in accordance with Paragraph 4 of Article 16 of the Federal Law "On Information, Information Technologies and the Protection of Information," of the Russian Federation.
10. DURATION OF THE PUBLIC OFFER
10.1 The public offer goes into effect from the moment of its acceptance by the website visitor/user/buyer and is valid until the withdrawal of the acceptance of the Public Offer.
11. ADDITIONAL TERMS
11.1. The seller is entitled to pass-on, or in any other way, transfer his rights and obligations toward the user/buyer to the seller's partnered third parties.
11.2. The online store and its offered services may be temporarily, partially, or completely unavailable due to interior reorganisation, maintenance, or any other technical work. The seller's technical services has the right to periodically carry out necessary work for maintance, updates, or any other technical issues without informing the website visitor/user/buyer first.
11.3. In relationships between the website user/buyer and the website seller, the relationships and their terms are subject to laws and provisions of the Russian Federation.
11.4. In case of questions or complaints from the user/buyer, they must contact the seller by telephone or any other form of accesible communication. The parties will attempt to resolve all disputes through negotiations, if no agreemnt is reached however, the dispute will be referred to the judicial authority in accordance to the current legislation of the Russian Federation.
11.5. In case a court decides to acknowledge any of the statements above as invalid, that kind of decision does not refer to the rest of the statements.
